Green v. Cottrell, 346 S.C. 53. 550 SE 2d 321 (Ct. App. 2001): Probate dispute where a will was executed before a marriage and husband, who had no health warnings, died suddenly after marriage and within a few days, wife, who was omitted from the will, died as well. Court ruled Cottrell was not an omitted spouse pursuant to S.C. Code 62-2-301. Dorchester County case.
Lever v. Lighting Galleries, 374 S.C. 30, 647 S.E. 2d 214, (S.C. Supreme Court 2007): Lever challenged Mortgage in Aiken County where Defendants had received a judgment against him and failed to foreclose the mortgage. The Master in Equity removed the mortgage, striking it as dissolved after the expiration of the ten year period of the judgement. The Supreme Court reversed and allowed the Defendants to pursue the mortgage foreclosure even though the underlying note/obligation had been removed by the expiration of the 10-year period.
